The Subrogation Process
Subrogation is the process of seeking reimbursement from the responsible party for a paid claim and your deductible.
When do we subrogate a claim?
A good example of when we take a claim into subrogation is if you have a covered loss, such as a car accident, and you submit your claim to us, but another party is actually responsible for all or part of the damages.
In the above case, we may pay your claim (payment determined by your coverages) and then seek reimbursement from the other party. Whether we pursue subrogation depends on the circumstances surrounding the loss, the laws in your state and your policy provisions.
Your cooperation with us in the investigation phase of the claim process is important. Your assistance can help to establish important facts, preserve evidence, and may help to accelerate the recovery process.
Early intervention is key
By gathering facts and developing a strategy early in the life of a claim, we often obtain better recoveries for our policyholders. At CWG we have a Home Office Subrogation Team that gets involved early in claims that may be appropriate for subrogation.
